1. Overview
WISHUPON respects your right to privacy. WISHUPON provides this Privacy Policy to inform you of our policies and procedures regarding the collection, use, disclosure and protection of information that apply to our Service, as well as your choices regarding the collection and use of information.

WISHUPON is a service that allows to save products and wish list from any online stores and to get sale alerts for your collected wish(products).

2. Personally Identifiable Information
To use the WISHUPON service, an email address, username and password are required. Also you will be required to register by providing us as well as your birth date, and gender. We use personally identifiable information to deliver the Service, to comply with reasonable requests of law enforcement and recommend additional content to you. You are not required by law to provide us with any such information, but by using the Services and agreeing to the Terms you agree to provide us with such information.

3. Personally Identifiable Information
We collect information that can be used to identify you as an individual (“Personally Identifiable Information”) only when you provide such information directly to us in connection with the Service. We ask for Personally Identifiable Information such as your name and e-mail address when you register for the Service, or if you correspond with us (in which case we will also retain our responses). We may also retain any messages you send through the Service, and may collect information you provide in User Content you post to the Service.

4. Non-Personally Identifiable Information
We also collect and use information about your interactions with the Service in a manner and format that does not identify you as an individual (“Non-Personally Identifiable Information”). We may collect, use, and disclose Non-Personally Identifiable Information as set forth below.

Wish list information: When you save products using our button(“Wish it” or “Save”), we collect data regarding the product that you tagged. This data includes the title, product name, price, image, store name, color, size, description, your rating, meta-tag and the url to the applicable third-party online store. When you buy products using WISHUPON application, website, blogs or any email links, we collect data regarding the product that you purchased. This data include purchase amount, date of purchase and name of online store.

Analytics Information: We use third-party analytics tools to help us measure traffic and usage trends for the Service. These tools collect information sent by your application as part of a page request and other information that assists us in improving the Service. We collect and use this analytics information in aggregate form such that it cannot reasonably be manipulated to identify any particular individual user.

Log File Information: When you use our Service, our servers automatically record certain log file information. These server logs may include anonymous information such as your web request, Internet Protocol (“IP”) address, device type, number of wish lists, product information, and how you interact with links on the Service, online store names, landing pages, and other such information. In addition, when you use WISHUPON certain information may be automatically gathered about your computer, browser, operating system, geo-location, IP address or mobile device, or in respect of any other of your activities using the Services.
5. Security
WISHUPON is very concerned with safeguarding your information. WISHUPON uses commercially reasonable safeguards to preserve the integrity and security of all information collected through the Service. To protect your privacy and security, we take reasonable steps (such as requesting a unique password) to verify your identity before granting you access to your account. You are responsible for maintaining the secrecy of your unique password and account information, and for controlling access to your email communications from WISHUPON, at all times.

We follow generally accepted industry standards to protect the Personal Information submitted to us, both during transmission and once we receive it. However, no method of transmission over the Internet, or method of electronic storage is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security. We will delete any information provided to us by a user upon the receipt of a written (including via email) request by such user. We cannot restore information once it has been deleted.

6. Referral Service and Requesting References
WISHUPON provides a referral service that allows you to invite your friends and contacts to use WISHUPON. We may integrate the Platform with third party sites such as Facebook, so that you can send invitation messages or requests for references via the third party site itself.

You may also send invitation/request emails via the Platform itself, in which case we will ask you for the contact information to which to send your invitation/request. You can type in the email addresses or other contact information manually, or you can choose to import the contacts in your address book(s). In both cases, we may use and store this information for the sole purposes of allowing you to send your friends and contacts an invitation or request for a reference, and for fraud detection and prevention. With respect to referrals, we will also store the email addresses of your invitees to track if your friend joins WISHUPON in response to your referral.

7. Third Party Sites and Services
Portions of the Services (including, without limitation, advertisements) may involve linking to or using websites or services belonging to third parties. The Services may also provide you with links to access the websites of third-party vendors or retailers. We have no control over third-party websites or services, and all use of third-party websites or services is at your own risk. WISHUPON cannot accept responsibility for the privacy policies of any such websites. WISHUPON is not responsible for content or available by means of such websites or services. WISHUPON does not endorse any products offered by third parties and we urge our users to exercise caution in using third-party websites or services.

8. Children
WISHUPON does not knowingly collect Personal Information from children under the age of 14. In the event you become aware that an individual under the age of 14 has enrolled without parental permission, please advise us immediately.

1. Your Relationship with WISHUPON

WISHUPON Inc., (“we”, “us” or “WISHUPON”) provides a proprietary tool allowing users to save third-party products which you are interested in purchasing. Your use of the WISHUPON apps, website and any WISHUPON software, data feeds and services (collectively the "Service") is subject to the terms of a legal agreement between you and WISHUPON. "WISHUPON" means WISHUPON Inc., whose principal place of business is at 66, Eulji-ro, Jung-gu, Seoul, South Korea.

Your legal agreement with WISHUPON is made up of (A) the terms and conditions set out in this document, (B) WISHUPON's Privacy Policy (https://wishupon.app/policy/privacy/en/index.html) (collectively called the "Terms").

The Terms form a legally binding agreement between you and WISHUPON in relation to your use of the Service. It is important that you take the time to read them carefully.

The Terms apply to all users of the Service, including users who are also contributors of Content, on the Service. "Content" includes wish lists, text, data of wish lists, software, scripts, graphics, photos, sounds, music, videos, audiovisual combinations, interactive features and other materials you may view on, access through or contribute to the Service.

In order to use the WISHUPON, you must be 14 years of age or older, or have the permission of your parent or guardian. You may not use WISHUPON if your access to or use thereof violates any applicable law or regulation.

2. Accepting the Terms

In order to use the Service, you must firstly agree to the Terms. You may not use the Service if you do not accept the Terms. You can accept the Terms by simply using the Service. You understand and agree that WISHUPON will treat your use of the Service as acceptance of the Terms from that point onwards. You may not use the Service and may not accept the Terms if (a) you are not of legal age to form a binding contract with WISHUPON, or (b) you are a person who is either barred or otherwise legally prohibited from receiving or using the Service under the laws of the country in which you are resident or from which you access or use the Service. You should print off or save a local copy of the Terms for your records.

3. Changes to the Terms

WISHUPON reserves the right to make changes the Terms from time to time, for example to address changes to the law or regulatory changes or changes to functionality offered through the Service. Therefore you must look at the Terms regularly to check for such changes. The modified version of the Terms (the "Modified Terms") will be posted at http://www.wishupon.company or made available within the Service (for any modified additional terms). If you do not agree to the Modified Terms you must stop using the Service. Your continued use of the Service after the date the Modified Terms are posted will constitute your acceptance of the Modified Terms.

4. WISHUPON Accounts

In order to access some features of the Mobile Application, Website or other elements of the Service, you will have to create a WISHUPON account. When creating your account, you must provide accurate and complete information. It is important that you must keep your WISHUPON account password secure and confidential. You must notify WISHUPON immediately of any breach of security or unauthorised use of your WISHUPON account that you become aware of. You agree that you will be solely responsible (to WISHUPON, and to others) for all activity that occurs under your WISHUPON account.

5. General Restrictions on Use

WISHUPON hereby grants you permission to access and use the Service, subject to the following express conditions, and you agree that your failure to adhere to any of these conditions shall constitute a breach of these Terms on your part:

You agree not to distribute any part of or parts of the Website or the Service, including but not limited to any Content, in any medium without WISHUPON's prior written authorisation, unless WISHUPON makes available the means for such distribution through functionality offered by the Service (such as the WISHUPON sharing feature);
You agree not to alter or modify any part of the Website or any of the Service (including but not limited to the WISHUPON and its related technologies);
You agree not to access Content through any technology or means other than the webpages of the Website itself, the WISHUPON, or such other means as WISHUPON may explicitly designate for this purpose;
You agree not to (or attempt to) circumvent, disable or otherwise interfere with any security related features of the Service or features that (i) prevent or restrict use or copying of Content or (ii) enforce limitations on use of the Service or the content accessible via the Service;
You agree not to use the Service (including the WISHUPON) for any of the following commercial uses unless you obtain WISHUPON's prior written approval:
You agree not to use or launch any automated system (including, without limitation, any robot, spider or offline reader) that accesses the Service in a manner that sends more request messages to the WISHUPON servers in a given period of time than a human can reasonably produce in the same period by using a publicly available, standard (i.e. not modified) web browser;
You shall not copy, reproduce, distribute, transmit, broadcast, display, sell, license, or otherwise exploit any Content for any other purposes without the prior written consent of WISHUPON or the respective licensors of the Content.
You agree that you will comply with all of the other provisions of the Terms at all times during your use of the Service. WISHUPON is constantly innovating in order to provide the best possible experience for its users. You acknowledge and agree that the form and nature of the Service which WISHUPON provides may change from time to time without prior notice to you. As part of this continuing innovation, you acknowledge and agree that WISHUPON may stop (permanently or temporarily) providing the Service (or any features within the Service) to you or to users generally at WISHUPON's sole discretion, without prior notice to you. You may stop using the Service at any time. You do not need to specifically inform WISHUPON when you stop using the Service.

You agree that you are solely responsible for (and that WISHUPON has no responsibility to you or to any third party for) any breach of your obligations under the Terms and for the consequences (including any loss or damage which WISHUPON may suffer) of any such breach.

6. Copyright Policy

WISHUPON operates a clear copyright policy in relation to any Content that is alleged to infringe the copyright of a third party. As part of WISHUPON's copyright policy, WISHUPON will terminate user access to the Service if a user has been determined to be a repeat infringer. A repeat infringer is a user who has been notified of infringing activity more than twice.

7. Content

Content stands for the information of saved products and wish lists which you created in certain webpage (collectively the "Content"). As a WISHUPON account holder you may submit Content. Your Content may be exposed to WISHUPON’s other users without any information of your account or name. You retain all of your ownership rights in your Content(wish lists), but you are required to grant limited license rights to WISHUPON and other users of the Service.

You understand and agree that you are solely responsible for your own Content and the consequences of posting or publishing it to various search engine such as Google, Bing and etc. WISHUPON does not endorse any Content or any opinion, recommendation, or advice expressed therein, and WISHUPON expressly disclaims any and all liability in connection with Content.

You represent and warrant that you have (and will continue to have during your use of the Service) all necessary licenses, rights, consents, and permissions which are required to enable WISHUPON to use your Content for the purposes of the provision of the Service by WISHUPON, and otherwise to use your Content in the manner contemplated by the Service and these Terms.

You agree that you will not post or upload any Content which contains material which it is unlawful for you to possess in the country in which you are resident, or which it would be unlawful for WISHUPON to use or possess in connection with the provision of the Service.

You agree that Content you submit to the Service will not contain any third party copyright material, or material that is subject to other third party proprietary rights (including rights of privacy or rights of publicity), unless you have a formal license or permission from the rightful owner, or are otherwise legally entitled, to post the material in question and to grant WISHUPON the license referred to in paragraph below.

On becoming aware of any potential violation of these Terms, WISHUPON reserves the right (but shall have no obligation) to decide whether Content complies with the content requirements set out in these Terms and may remove such Content and/or terminate a User's access for uploading Content which is in violation of these Terms at any time, without prior notice and at its sole discretion.

You further understand and acknowledge that in using the Service, you may be exposed to Content that is factually inaccurate, offensive, indecent, or otherwise objectionable to you. You agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against WISHUPON with respect to any such Content.

8. License Rights

When you upload or post Content to WISHUPON, you grant:

to WISHUPON, a worldwide, non-exclusive, royalty-free, transferable license (with right to sub-license) to use, reproduce, distribute, prepare derivative works of, display, and perform that Content in connection with the provision of the Service and otherwise in connection with the provision of the Service and WISHUPON's business, including without limitation for promoting and redistributing part or all of the Service (and derivative works thereof) in any media formats and through any media channels;
to each user of the Service, a worldwide, non-exclusive, royalty-free license to access your Content through the Service, and to use, reproduce, distribute, prepare derivative works of, display and perform such Content to the extent permitted by the functionality of the Service and under these Terms.
The above licenses granted by you in Content terminate when you remove or delete your Content from the Website. The above licenses granted by you in textual comments you submit as Content are perpetual and irrevocable, but are otherwise without prejudice to your ownerships rights, which are retained by you as set out in paragraph above.

9. WISHUPON Content

With the exception of Content submitted to the Service by you, all other Content on the Service is either owned by or licensed to WISHUPON, and is subject to copyright, trade mark rights, and other intellectual property rights of WISHUPON or WISHUPON's licensors. Any third party trade or service marks present on Content not uploaded or posted by you are trade or service marks of their respective owners. Such Content may not be downloaded, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purpose whatsoever without the prior written consent of WISHUPON or, where applicable, WISHUPON's licensors. WISHUPONR and its licensors reserve all rights not expressly granted in and to their Content.

10. Links from WISHUPON

The Service may include hyperlinks to other online stores sites that are not owned or controlled by WISHUPON. WISHUPON has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party websites. You acknowledge and agree that WISHUPON is not responsible for the availability of any such external sites or resources, and does not endorse any advertising, products or other materials on or available from such web sites or resources.

You acknowledge and agree that WISHUPON is not liable for any loss or damage which may be incurred by you as a result of the availability of those external sites or resources, or as a result of any reliance placed by you on the completeness, accuracy or existence of any advertising, products or other materials on, or available from, such web sites or resources.

WISHUPON encourages you to be aware when you leave the Service and to read the terms and conditions and privacy policy of each other website that you visit.

You may tap the save feature button(‘Wish it’ or ‘Save’ Button) and use it to archive products and wish lists that you are interested in third-party online stores. We will notify you when the prices drops for your collected products or wish lists. We will also show you the products that you have saved on WISHUPON with product names, prices, images, ratings, online stores name and its properties. Please note that we are not affiliated with such third-party online stores, nor do we endorse anything provided on them, including the products that you archived. While we make reasonable attempts to notify you of changes in prices with respect to the particular version of the product that you saved, we do not warrant that the prices that are included in our notification will be the actual price of the relevant product and/or that the relevant product will actually be available for sale. We only provide you with notifications and/or related information and are not responsible for the actions of such third-party online store and/or that such online store will respect any agreements entered and/or purchases made. We do not warrant that any product is safe, legal or appropriate. We expressly disclaim any and all liability in connection with the above.

All products featured on our service are independently selected by WISHUPON team. Occasionally, we use affiliate links on WISHUPON. WISHUPON may earn a portion of sales revenue from purchases made through affiliate links on our app and website.

11. Ending Your Relationship with WISHUPON

The Terms will continue to apply until terminated by either you or WISHUPON as set out below. If you want to terminate your legal agreement with WISHUPON, you may do so by (a) notifying WISHUPON at any time and (b) closing your WISHUPON account. Your notice should be sent, in writing, to WISHUPON's address which is set out at the beginning of these Terms. WISHUPON may at any time terminate its legal agreement with you if:

you have breached any provision of the Terms (or have acted in manner which clearly shows that you do not intend to, or are unable to comply with the provisions of the Terms); or
WISHUPON is required to do so by law (for example, where the provision of the Service to you is, or becomes, unlawful); or
WISHUPON may terminate its legal agreement with you if:

WISHUPON is transitioning to no longer providing the Service to users in the country in which you are resident or from which you use the Service; or
the provision of the Service to you by WISHUPON is, in WISHUPON's opinion, no longer commercially viable and in the case of each of A and B, where possible, give reasonable notice of such termination.
When these Terms come to an end, all of the legal rights, obligations and liabilities that you and WISHUPON have benefited from, been subject to (or which have accrued over time whilst the Terms have been in force) or which are expressed to continue indefinitely, shall be unaffected by this cessation, and the provisions of paragraph 14 shall continue to apply to such rights, obligations and liabilities indefinitely.

12. Exclusion of Warranties

Nothing in the Terms shall affect any statutory rights that you are always entitled to as a consumer and that you cannot contractually agree to alter or waive. The Service is provided "as is" and WISHUPON makes no warranty or representation to you with respect to them. 
In particular WISHUPON does not represent or warrant to you that:

Your use of the Service will meet your requirements,
Your use of the Service will be uninterrupted, timely, secure or free from error,
Any information obtained by you as a result of your use of the Service will be accurate or reliable, and
That defects in the operation or functionality of any software provided to you as part of the Service will be corrected.
No conditions, warranties or other terms (including any implied terms as to satisfactory quality, fitness for purpose or conformance with description) apply to the Service except to the extent that they are expressly set out in the Terms. Your use of any aspect of the Services is at your own risk. WISHUPON cannot and does not accept any liability in respect of any activities that you may undertake through using the Services, including by means of linking to third-party websites and/or any purchases made on those third-party websites.

13. Limitation of Liability

Nothing in these Terms shall exclude or limit WISHUPON's liability for losses which may not be lawfully excluded or limited by applicable law. Subject to the overall provision above WISHUPON shall not be liable to you for:

Any indirect or consequential losses which may be incurred by you. This shall include; (i) any loss of profit (whether incurred directly or indirectly); (ii) any loss of goodwill or business reputation; (iii) any loss of opportunity; or (iv) any loss of data suffered by you;

Any loss or damage which may be incurred by you as a result of: 

i. Any reliance placed by you on the completeness, accuracy or existence of any advertising, or as a result of any relationship or transaction between you and any advertiser or sponsor whose advertising appears on the Service; 
ii. Any changes which WISHUPON may make to the Service, or for any permanent or temporary cessation in the provision of the Service (or any features within the Service); 
iii. The deletion of, corruption of, or failure to store, any Content and other communications data maintained or transmitted by or through your use of the Service; 
iv. Your failure to provide WISHUPON with accurate account information; 
v. Your failure to keep your password or WISHUPON account details secure and confidential.
The limitations on WISHUPON's liability to you in paragraph above shall apply whether or not WISHUPON has been advised of or should have been aware of the possibility of any such losses arising.

WISHUPON does not endorse any products offered by any third party. The Services may provide links to third-party websites or third-party services or resources. We have no control over third-party websites, content or resources and all use of the foregoing is at your own risk. Additionally, all payments made to purchase goods or services are made through third-party payment processors. We cannot accept responsibility for any payments processed or submitted through such third-party payment processors, or for the privacy policies of any such services.

14. Payment, Cancellation, and Refunds

A. Automatic Renewal and Payment

Subscriptions to our paid Wishupon Plus service are available on monthly subscription plans. The paid subscription is valid for only one user account. Your paid Wishupon Plus subscription will BE AUTOMATICALLY RENEWED, and the subscription fee will be charged, at the end of each subscription period until you cancel. We may offer a free trial period for Wishupon Plus. If you sign up for a free trial, you will be charged the subscription fee when the free trial period ends, and at the end of each subsequent subscription period until you cancel.

Users in certain regions may be required to pay local taxes, which will be calculated and added to the total cost of a purchase. Payment providers may apply their own commissions and conversion rates to payments in various currencies. This is outside of Wishupon’s control.>

If your payment method is declined, you must provide new payment information or your Wishupon Plus subscription will be canceled. If you provide new payment information and are successfully charged, your new subscription period will be based on the original renewal date and not the date of the successful charge. If you do not pay for your paid subscription on time, we reserve the right to suspend your paid subscription or reduce your service level to our free service.

B. Cancelling a Subscription and Refunds

You may cancel Wishupon Plus at any time. If you purchased Wishupon Plus using your Apple ID, you could cancel your subscription in the Subscriptions section of the Apple App Store. Your subscription will remain active from the time you cancel until the end of your current billing period. Deleting your Wishupon account or removing the Wishupon application from your device does NOT cancel your subscription.

If you cancel or decide not to renew, you will be downgraded to our free service upon cancellation or at the end of your subscription period, as applicable.

You will NOT receive a refund for any remaining days in your current billing period.

C. The Scope of Paid Wishupon Plus Services and Advance Notice

We reserve the right in the future to charge for use of our services that are currently available free of charge. We may add new features to the Wishupon Plus. Also, we may remove some of the existing features if we are no longer able to provide them for legal or technical reasons. We will provide users with notice of any material change to the terms and conditions applicable to the subscription service at least thirty days prior to such change taking effect.

By continuing to use our services after the change takes effect, you accept the new terms. You will have the opportunity to cancel your subscription before the new fee comes into effect.

15. Payment Legal Terms

In connection with your requested purchasing, you will be asked to provide customary billing information such as name, billing address and credit card information third-party payment processor, PayPal and Apple Pay. You agree to pay WISHUPON for any confirmed purchasing made in connection with your WISHUPON Account in accordance with these Terms by one of the methods described on the Site or Application, e.g. by PayPal. You hereby authorize the collection of such amounts by charging the credit card provided as part of requesting purchase via a third-party online payment processor, PayPal or Apple Pay.

16. General Legal Terms

The Terms constitute the whole legal agreement between you and WISHUPON and govern your use of the Service and completely replace any prior agreements between you and WISHUPON in relation to the Service. You agree that WISHUPON may provide you with notices, including those regarding changes to the Terms, by email, regular mail, or postings on the Service.

You agree that if WISHUPON does not exercise or enforce any legal right or remedy which is contained in the Terms (or which WISHUPON has the benefit of under any applicable law), this will not be taken to be a formal waiver of WISHUPON's rights and that those rights or remedies will still be available to WISHUPON.

If any court of law, having the jurisdiction to decide on this matter, rules that any provision of these Terms is invalid, then that provision will be removed from the Terms without affecting the rest of the Terms. The remaining provisions of the Terms will continue to be valid and enforceable.

You acknowledge and agree that each member of the group of companies of which WISHUPON is a part shall be third party beneficiaries to the Terms and that such other companies shall be entitled to directly enforce, and rely upon, any provision of the Terms which confers a benefit on (or rights in favour of) them. Other than this, no other person or company shall be a third party beneficiary of the Terms.
